NIGERIAN SENATOR SLAMS VOICE VOTING ON EMERGENCY RULE DECLARATION


In a strongly-worded statement, Senator Ireti Kingibe, representing the Federal Capital Territory (FCT) on the Labour Party platform, has expressed her opposition to the use of voice voting in the National Assembly's decision on the recent emergency rule declaration.


Senator Kingibe emphasized that the Nigerian Constitution requires a two-thirds majority for such critical decisions, which cannot be accurately determined through voice voting. She cited Section 305(2) & (6)(b) of the 1999 Constitution, which mandates the approval of at least two-thirds of all members of each House.


The senator argued that a recorded vote, such as through division voting, roll call, or electronic voting, is necessary to ensure compliance with constitutional requirements. She also pointed out that the Senate Standing Orders and House Rules generally mandate a roll call or electronic voting system for decisions of this magnitude.


Senator Kingibe stressed the importance of the National Assembly's role in guarding the Constitution and ensuring the rule of law prevails. She also emphasized the need for accountability, stating that without a recorded vote, the people cannot take responsibility for the President's decisions.
